COMPETITION RULES
Joystick Junkies & Foot Locker promotion
This Competition is organized by Joystick Junkies (Sports Finance International Ltd) the “Promoter”).
These Competition Rules govern the conduct of the Competition. Your participation means that you accept these Competition Rules. Please read these carefully prior to entering the Competition.
All Competition entries must be received by the Promoter by 31/07/11. Entry is limited to one per person. No purchase is necessary to enter.
1. WHO CAN PARTICIPATE IN THE COMPETITION ?
The Competition is open to residents of the UK, Spain Germany, Austria, Belgium, Denmark, Ireland, , Luxembourg, , and the Netherlands . Employees of the Promoter and of Foot Locker, any of their subsidiaries, agents or any other business involved with the administration of this Competition, as well as their family members are not eligible to participate.
2. HOW WILL THE COMPETITION BE RUN ?
2.1 The Competition will run from 31/5/11 to 31/7/11. To enter the Competition, participants need to go online to www.joystickjunkies.com/footlocker and follow the instructions, and follow the instructions on the web page.
2.2 Except in the event of negligence, fault or deliberate acts or omissions on the part of the Promoter or its agents, the Promoter does not accept responsibility for any entries lost, damaged, corrupted, delayed, quarantined, or not received by the promoter, whatever the cause; and the promoter is not responsible or liable for any technical, hardware, software, server, website, or other, failures or damage of any kind.
3. THE PRIZE
3.1 The prize consists of a 250GB Xbox 360 console and two free video games. A winner younger than 18 years will receive video games with a rating appropriate to their age
3.2 In the event of non-availability of the prize for any reason, the promoter reserves the right to substitute the prize with a prize of a similar nature. No cash alternative will be available. The prize is not transferable. Any taxes which may be applicable to prizes, shall be the responsibility of the winners.
3.3 Except in the event of negligence, fault or deliberate acts or omissions on the part of the Promoter or its agents, the Promoter does not accept responsibility for any prizes lost, damaged, delayed, or not received by the winner, whatever the cause, and will not replace such prizes
4. THE WINNERS
4.1 . The winner will be drawn at random from all correct entries received by the closing date.
4.2 The winner will be notified by email as soon as practicable following the end of the Competition. Winners need to confirm acceptance of the prize ultimately within 2 weeks after they have been informed about the prize. If no timely acceptance has been received by Promoter, the winners lose their right to claim the prizes, in which case the prizes may be cancelled.
4.3 If a winner rejects the prize, we are very sorry, but no alternatives will be offered. Substitute winners may be selected.
5. PARTICIPANT’S DECLARATION
Winning entrants may be required to participate in advertising or promotional activity for the Promoter, without payment. In addition, the Promoter will have the right, at its absolute discretion and without payment or permission to the winner, to use the winners’ video, pictures, name, region of residence or likeness for the purposes of announcing the winner of the promotion and for related promotional purposes.
You hereby agree that Promoter shall be entitled to use such video, pictures, name, region of residence or likeness and that this information and/or these images may be posted on Promoter’s website or any other Foot Locker operated website, or used in any other media for marketing or other business purposes, without compensation or prior approval by you. Promoter shall have all rights related to such images and their use.
6. PERSONAL DATA
6.1 Your personal data will be used for the purposes of executing the Competition and to send you communications and/or promotions related to the Competition, and, if you have opted in, for sending newsletters and information about promotions and marketing initiatives launched by Joystick Junkies (Sports Finance International Ltd).
6.2 Promoter shall only transfer your personal data to affiliated companies and/or third parties to the extend that this is necessary for the executing of this Competiton or in the event that this is necessary in order to send you newsletters.
6.3 Your personal data will be processed in accordance with the applicable data protection laws and the privacy policy of Joystick Junkies which can be found on this website.
You can exercise your rights of access, correct, cancel or disagree with the personal data by contacting info@joystickjunkies.com, clearly indicating your name, surname, address and e-mail address.
6.4 Moreover, by enterting this competition you consent to the Promoter sharing your personal information with Freedom Sportsline Ltd for the purposes of executing this competition.
By entering the competition, all entrants consent to the processing and use of this data.
7 DISCLAIMERS
7.1 Except in the event of negligence, fault or deliberate acts or omissions on the part of the Promoter or its agents, the Promoter does not accept responsibility for any entries lost, damaged, corrupted, delayed, quarantined, or not received by the Promoter, whatever the cause; and the Promoter is not responsible or liable for any technical, hardware, software, server, website, or other, failures or damage of any kind.
7.2 Promoter reserves the right, in its sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of the Competition or to be acting in violation of these Competition Rules. Any attempt by any participant to undermine the Competition may be a violation of civil and criminal law, and Promoter reserves the right to seek damages and/or any other remedies allowed by law from such participant.
7.3 In the event of obvious error in these rules, illegality, or circumstances beyond the reasonable control of the Promoter which prevent the administration of the promotion, the Promoter reserves the right to amend these rules or withdraw the promotion. The Promoter will not be liable for any form of loss or disappointment caused by same. In such circumstances the Promoter will make all reasonable endeavours to advise entrants of any changes or withdrawal.
8. MISCELLANEOUS
8.1 Entries which are incomplete, incorrect, or fraudulent, will not be eligible to win. By submitting an entry, entrants agree to be bound by these rules.
If any provision or part of these Rules is deemed void or unenforceable, then that provision or part shall be deemed excluded and the remainder of the Rules shall remain applicable.

2. WIE WIRD DAS GEWINNSPIEL DURCHGEFÜHRT?

2.2 Außer im Falle der Fahrlässigkeit, Abweichungen, vorsätzlichem Fehlverhalten oder Versäumnissen seitens des Veranstalters oder seiner Beauftragten, übernimmt der Veranstalter keine Verantwortung für verlorengegangene, unvollständige, unzulässige, verspätete, nicht zugestellte oder nicht beim Veranstalter eingegangene Teilnahmen. Der Veranstalter kann für jeglichen technischen Fehler die Hardware, Software, Server, Webseite betreffend nicht haftbar gemacht werden.
3. DER GEWINN
3.1 Der Gewinn besteht aus seiner 250 GB Xbox Konsole und zwei kostenlosen Videospielen. Sollte der Gewinner unter 18 Jahren sein, erhält er ein Videospiel, das den Jugendschutzbestimmungen entspricht.
3.2 Sollte der Gewinn aus welchen Gründen auch immer nicht zur Verfügung stehen, behält sich der Veranstalter vor, den Gewinn angemessen zu ersetzen. Der Gewinn kann nicht in bar ausgezahlt werden. Der Gewinn ist nicht übertragbar. Jegliche Steuern, die auf den Gewinn anwendbar sein sollten, liegen in der Verantwortung der Gewinner.
3.3 Außer im Falle der Fahrlässigkeit, Abweichungen, vorsätzlichem Fehlverhalten oder Versäumnissen seitens des Veranstalters oder seiner Beauftragten, übernimmt der Veranstalter keine Verantwortung für verlorengegangene, beschädigte, verspätete oder nicht beim Gewinner eingegangene Gewinne. 4. DIE GEWINNER
4.1 Der Gewinner wird unter allen zulässigen Teilnehmern per Zufall ausgelost.
4.2 Der Gewinner wird per Email benachrichtigt, sobald das nach dem Wettbewerb möglich ist. Gewinner müssen den Gewinn bis spätestens zwei Wochen nach Benachrichtigung akzeptieren. Wenn der Veranstalter innerhalb dieser zwei Wochen keine Bestätigung erhalten hat, verliert der Gewinner das Recht an dem Gewinn.
4.3 Wenn der Gewinner die Annahme des Gewinns verweigert, werden keine Alternativen angeboten. Ersatzgewinner können ausgewählt werden.
5. ERKLÄRUNG DER TEILNEHMER
Gewinnspielteilnehmer können für gewerbliche Zwecke oder Veranstaltungen von dem Veranstalter ohne Gegenleistung genutzt werden. Daneben hat der Veranstalter das Recht, in Diskretion und ohne Bezahlung oder Erlaubnis des Gewinners, Videos, Bilder, Namen, Wohnort oder Abbildungen des Gewinners für die Gewinnerbekanntgabe und ähnliche veranstaltungsgebundene Verwendungszwecke zu nutzen.
Hiermit stimmt der Gewinner zu, dass der Veranstalter berechtigt wird Videos, Bilder, Namen, Wohnort oder Abbildungen des Gewinners zu nutzen und dass diese Informationen und/oder Abbildungen auf der Webseite des Veranstalter oder auf anderen Foot Locker Webseiten veröffentlicht oder für andere Medien des Marketings oder anderen relevanten Abbildungen ohne Kompensation oder bevorzugter Nutzung des Gewinners verwendet werden können. Der Veranstalter hat alle Rechte an den diesbezüglichen Bildern und ihrer Verwendung.
6. PERSÖNLICHE DATEN
6.1 Die persönlichen Daten werden für die Darstellung des Gewinnspielablaufs und die Versendung von Informationen und/oder Veranstaltungen zum Gewinnspiel und insofern eine Zustimmung erfolgte für den Versand des Newsletters und Informationen zu weiteren Veranstaltungen und Marketingaktionen von Joystick Junkies (Sports Finance International Ltd.) genutzt.
6.2 Der Veranstalter übermittelt die persönlichen Daten nur an beteiligte Unternehmen und/oder Dritte, die mit der Durchführung des Gewinnspiels betraut sind oder in dem Falle, dass für den Versand des Newsletters die Notwendigkeit der Übermittlung besteht.
6.3 Die persönlichen Daten werden in Abstimmung mit den bestehenden Datenschutzgesetzen und den Datenschutzrichtlinien von Joystick Junkies, die auf der Webseite nachgelesen werden können, verarbeitet.
6.4 Die Rechte auf Zugang, Korrektur, Löschen oder Widerspruch der persönlichen Daten können mit einer Mail unter Angabe des eindeutigen Vor- und Zunamens, Adresse und Emailadresse an info@joystickjunkies.com in Anspruch genommen werden.
6.5 Ferner willigen die Teilnehmer des Gewinnspiels der Weitergabe ihrer persönlichen Daten an Freedom Sportline Ltd für die Darstellung der Gewinnspieldurchführung zu.
Mit der Teilnahme am Gewinnspiel stimmen die Teilnehmer der Durchführung und der Datennutzung zu.
7. HAFTUNGSAUSSCHLUSS

3. EL PREMIO
3.1 El premio consiste en una videoconsola Xbox 360 de 250 GB y dos juegos gratuitos. Si el ganador es menor de 18 años, recibirá un juego en consonancia a su edad.
3.2 En el caso de no disponibilidad del premio por cualquier razón, el promotor se reserva el derecho a sustituir el premio por otro de naturaleza similar. En ningún caso se entregará efectivo por valor del premio. El premio es intransferible. Cualquier impuesto relativo a los premios, será responsabilidad de los ganadores.
3.3 Salvo en caso de negligencia, culpa o actos deliberados u omisiones por parte del Promotor o sus agentes, el Organizador no se hace responsable de ningún premio perdido, dañado, alterado, o no recibido por el ganador, sea cual sea la causa, y no reemplazará estos premios.
4. LOS GANADORES
4.1 . El ganador será elegido al azar entre todas las participaciones correctas recibidas antes de la fecha límite.
4.2 El ganador será notificado por e-mail tan pronto como sea posible después de finalizar la promoción. Los ganadores deberán confirmar que aceptan el premio en última instancia, como máximo 2 semanas después de que sean informados de que ganaron el premio. Si en este periodo de tiempo, el promotor no recibe la aceptación del premio, los ganadores perderán su derecho a exigir el premio y en ese caso los premios serán cancelados.
4.3 Si un ganador rechaza el premio, lo lamentamos, pero no habrá otras alternativas. Se escogerá a otros ganadores.
5. DECLARACIÓN DE LOS PARTICIPANTES
Los ganadores pueden ser requeridos para participar en la publicidad o en actividades promocionales del promotor, sin recibir contraprestación económica alguna. Al participar en esta promoción aceptas que el promotor tendrá derecho a utilizar el video, fotos, nombre, región de residencia y que esta información y/o las imágenes pueden ser publicados en la web del promotor o en cualquier otra web operativa de Foot Locker, o puede ser usado en cualquier otro medio de comunicación para su comercialización o para otros fines empresariales, sin compensación o aprobación previa. El promotor tendrá todos los derechos relacionados con este tipo de imágenes y su uso.
6. DATOS PERSONALES
6.1 Tus datos personales serán utilizados para llevar a cabo el concurso y para comunicarnos contigo y/o promociones relacionadas al concurso, y, si han optado, para el envío de boletines de noticias, e información sobre promociones y acciones de marketing lanzadas por Joystick Junkies (Sports Finance International Ltd).
6.2 El promotor solo podrá transferir tus datos personales a empresas afiliadas y/o a terceros en la medida en que sea necesario, para la ejecución de este concurso o en el caso de que sea necesario para enviarle boletines de noticias.

7. RENUNCIAS

7.2 El promotor se reserva el derecho, en su única discreción, para descalificar a cualquier persona que se encuentre manipulando el proceso de inscripción, o el funcionamiento del concurso o que esté violando estas normas de participación. Cualquier intento por parte de cualquier participante puede ser una violación de la ley civil y penal, y el promotor se reserva el derecho de reclamar daños y/o cualquier otro recurso permitido por la ley de ese participante.
7.3 En caso de error manifiesto en este reglamento, la ilegalidad, o circunstancias fuera del control razonable del promotor que impide la administración de este concurso, el promotor se reserva el derecho de modificar estas reglas o anular la promoción. El promotor no se hará cargo de ningún tipo de pérdida o decepción causada por la misma. 2.2 Sauf en cas de négligence, de fautes ou d’actes délibérés ou d’omissions de la part du Promoteur ou ses agents, le Promoteur ne serait être tenu responsable d’aucunes données perdues, endommagées, corrompues, retardées ou non reçues par le Promoteur, quelqu’en soit la cause; le promoteur ne saurait être tenu responsable des quelconques incidents technique, de matériel, logiciel, serveur, site Web, ou échecs ou dégâts d’aucune sorte.
3. LE LOT :
3.1 Le lot mis en jeu est une console Xbox 360 250GB et deux jeux vidéo offerts. En cas d’âge inférieur à 18 ans, le gagnant recevra des jeux vidéos dont l’évaluation est adaptée à son âge.
3.2 En cas de non-disponibilité du lot pour une raison quelconque, le promoteur se réserve le droit de substituer le prix avec un prix de nature semblable. Aucune alternative monétaire ne sera disponible. Le lot est remis de manière nominative est n’est pas transmissible. Les taxes applicables à la nature du lot restent à la charge du gagnant.
3.3 Sauf en cas de négligence, de fautes ou des actes délibérés ou d’omissions de la part du Promoteur ou ses agents, le Promoteur ne saurait être tenu responsable en cas de lot perdu, endommagé, retardé, ou non reçu par le gagnant, indépendamment de la cause et ne remplacera pas le dit prix.
4. LES GAGNANTS :
4.1. Le gagnant sera tiré au sort parmi l’ensemble des réponses correctes reçues à la date de clôture.
4.2 Le gagnant sera contacté par courrier électronique à l’issue du Concours. Les gagnants doivent confirmer l’acceptation du lot dans un délai de 2 semaines après avoir été informés de celui-ci. Si aucune confirmation n’a été reçue par le Promoteur, les gagnants perdent leur droit de réclamer leur lot, dans le cas où ceux-ci peuvent être annulés.
4.3 Si un gagnant rejette le prix, nous sommes dans le regret de ne pouvoir offrir aucune autre alternative. D’autres gagnants pourront alors être choisis en remplacement.

Le Promoteur se réserve le droit de demander au gagnant de participer à des activités publicitaires ou promotionnelles, sans prévision de rémunération. Vous reconnaissez par la présente que le Promoteur aura le droit d’utiliser des vidéos, des images, le nom, la région de résidence ou autres et que ces informations et/ou images peuvent être postées sur le site Web du Promoteur ou un autre site Web de Foot Locker affilié, ou utilisées dans d’autres médias pour le marketing ou d’autres raisons professionnelles, sans rémunération ou votre approbation préalable. Le promoteur disposera de l’ensemble des droits sur ces images et leur utilisation.

7.2 Le promoteur se réserve le droit, à sa seule discrétion, de disqualifier toute personne qui aurait falsifié le processus d’inscription ou le fonctionnement de la concours ou à agir en violation de ces règles. Toute tentative par un participant de porter atteinte au concours peut constituer une violation du droit civil et pénal, et le Promoteur se réserve le droit de réclamer des dommages et intérêts et / ou tout autre recours permis par la loi venant de ce participant.
